Terms of use and liability

In short: Watch My Lips is a free practice tool, offered as it is. It isn't medical advice, a hearing test or a treatment. The full terms follow.
1. These terms
These terms apply to your use of Watch My Lips at watchmylips.com (“Watch My Lips”, “we”, “us”). By using the site you agree to them. If you don't agree, please don't use the site. If you use it on behalf of a class or other organisation, you agree to them for that organisation too.
2. Using Watch My Lips
Watch My Lips is a free tool for practising lipreading (speechreading) in English. You may use it for your own learning and teaching. Please don't:
- try to break, overload or get around the site's security;
- use automated means to scrape it, download its clips, or create practice history in bulk;
- copy the site or its clips, or present them as your own;
- use it to break any law.
Watch My Lips is not directed at children under 13. A child under 13 should use it only with a parent, guardian or teacher, who is responsible for that use.
3. Accounts and your data
You can practise without an account. Signing in with Google is optional. You're responsible for keeping access to your Google account secure. What Watch My Lips keeps, and why, is set out in our privacy policy, which is part of these terms.
4. Content
The site's design, text and code belong to Watch My Lips. Most video clips are adapted from the GRID and CREMA-D research datasets under their licences, as set out on the credits page; the rest were recorded for Watch My Lips by people who agreed to their use here. Please don't download, copy or reuse clips except as those licences allow.
5. Practice only, not medical advice
Watch My Lips is a practice aid. It is not medical advice, a hearing test, a diagnosis or a treatment, and it is not a substitute for an audiologist, a doctor, hearing aids, or classes with a qualified lipreading teacher. If your hearing has changed, or you have pain, ringing or sudden loss, see a doctor.
Lipreading is never fully reliable, even for experts. Don't rely on lipreading, or on this site, where a misunderstanding could cause harm, such as medical, legal, financial or safety information. Ask for it in writing or through an interpreter or captions.
6. No warranty
Watch My Lips is provided free, “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement. We don't promise that the site will always be available, uninterrupted, secure or free of errors, that it will meet your needs or improve your lipreading, or that your progress, streaks or account will never be lost.
7. Limitation of liability
To the fullest extent the law allows:
- Watch My Lips and the people who run it will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, progress, profits or opportunity, arising from your use of the site or your inability to use it, even if we were told such loss was possible;
- we will not be liable for any loss arising from relying on lipreading, including in any of the situations listed in section 5;
- our total liability to you for any claim about the site is limited to the amount you paid us to use it in the 12 months before the claim, which, for a free service, is zero, or 50 US dollars where the law doesn't allow it to be zero.
Some places don't allow some of these exclusions or limits. Where that's so, they apply only as far as the law there allows, and nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.
8. Your responsibility
You agree to cover any claim, loss or cost (including reasonable legal fees) that we incur because you broke these terms or the law while using Watch My Lips.
9. Other services
Sign-in is provided by Google, and analytics by Mixpanel, under their own terms. We're not responsible for services or websites we link to and don't control.
10. Changes, suspension and ending
We may change, pause or close Watch My Lips, or any part of it, at any time. We may suspend or remove access for anyone who breaks these terms. You can stop using the site at any time, and ask us to delete your data as described in the privacy policy.
We may update these terms. If we do, we'll change the date at the top. Using the site after a change means you accept the new terms.
11. General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. These terms, with the privacy policy, are the whole agreement between you and us about Watch My Lips.
